American law is different, you are caught in someone elses house after breaking in, very bad what happens to you, but it is injury in commission of a crime. You can be shot dead and have no right to compensation if you were in another's house committing a crime. But yes, first thing and best thing is for the homeowner to flee the situation with all in the house, and phone the police.


To be fair, the courts over here are begining to see things like breaking and entering in a new light, and are more inclined to side with the homeowner should he take a swing at burglars, even if the burglars are hurt.

Not much use to them when they're dead, so why waste it on them!
I've been in court over a dozen times as a witness. With the last time being the best, for want of a better way of putting it. I'd spoken with the prosecution, whilst awaiting the case going into court. Explained that should any money be awarded to me, it be made payable to MacMillan Cancer. Judge ordered that a fixed sum be paid in parts, as and when it could be afforded. Prosecuter got up and put to the judge what had been said beforehand, resulting in an instant doubling of the amount payable, deductable immediatly from his benefits.
That was a partial result.

That does not happen very often, and in any case, he isn't going to pay really with money he has earned. It will be with money that he was given because he isn't working. Still it's better than nothing.

Its money he'd have received whilst inside and his girlfriend(who was involved) would have had part of, that was denied to them. Neither decision sat very well with his family & mates and I got a police escort out of the court, via the old tunnel.
