Pensioner to sue Tesco after pineapple leaves her with concussion


A pensioner is seeking compensation against a supermarket after suffering from head injuries as a result of being struck by a pineapple.
The woman, 76, was shopping in a Tesco supermarket in Dundee when she was hit on the head by a falling pineapple.
As a result, the woman suffered from concussion and was knocked to the floor.
The woman is now seeking compensation for her injuries on the basis that the fruit had been badly stacked.
She said: "I was in the reduced section for the fruit, looking at some on the second shelf. Another lady was looking at the pineapples on the top shelf. The next thing I knew - clunk - I got hit on the back of the head. I dropped my basket and staggered to the floor.
"My vision was blurred. I could not think straight. I sat there for a while and got my bearings. I didn't dare drive home, so I got them to phone my sister and come and pick me up."

The victim and her lawyer are trying to trace the witness.

He said: "It is her position the shelf was poorly stacked. Tesco say it was another customer who knocked it off. We are not seeking massive damages, but we would be looking for £3,000 or £4,000 to compensate for [the woman's] injuries."

However, Tesco said: "We will not accept liability for the actions of another customer."

Mr K was injured when a sign fell on him in a Tesco Superstore while he was walking down a shopping aisle, striking him on the head. Mr K sustained a 4 inch cut to his head that began to bleed copiously. A customer at the store called staff, and the deputy manager came to Mr K’s assistance, who was dazed and in some pain. Basic first aid was provided in the store’s cafeteria, and Mr K made a statement that was recorded in their accident book. He later saw his GP who dressed his wound and sent him home with a prescription of painkillers. Despite returning to the supermarket to discuss the matter further with the store manager, Tesco failed to contact him in the weeks after the accident, and Mr K therefore decided that his only option was to seek legal advice.
After a few months of correspondence we were able to win an admission of liability from the supermarket group’s insurers, and out client later received a cheque for £3,350 in compensation.




In both these cases a helmet could possibly have contributed to the individual's safety and reduced or prevented the head injury

Then there is also the problem of personal responsibility,, by failing to take such a common sense and simple preventative measure such as wearing a helmet, both these individuals have been guilty of conrbutory negligence and surely deserve to have the compensation payment cut accordingly?

I went in there this afternoon to buy a few bottles of beer when i was confronted by some security guard who asked me to take my bike helmet off. He told me that it was for security reasons, as "it covers my head, and it's an offensive weapon"! I pointed out the other head gear items being worn in the store such as jester type hats with bells on,veils, wooley hats, father Christmas hats and others. He said that mine wasn't allowed, just as helmets aren't allowed in banks and petrol stations. I pointed out to him that a cycle helmet doesn't cover the face therefore i'm not covering up my identity, but he wasn't having it and asked me to take it off or leave. He also said that it could be used as an offensive weapon, so i pointed out that that would only be the case if i took it off as he asked. What do you reckon jobsworth or what?!:thumbsdown:

Ask them why they are selling knives, alcohol and cigarettes .............. to the underaged. Also cycle helmets. Then if they then continue to be jobsworths tell them to go f**k themselves, go on twitter and shame them. Then go to Sainsburys.

I really don't understand why people sue over the most inane things. Guess what accidents happen! I'd be happy with getting 20 quids worth of vouchers or something. I think that's what we got when we spent an hour stuck in a lift in a local supermarket once.

Err ............. a display sign falling on your head, causing a 4 inch cut, which bled rather a lot is NOT inane imho. Maybe you should consult a dictionary to find out what "inane" really means. How would £20 of vouchers pay your mortgage, bills or feed your family if you were away from work because of your injuries? Anyway you probably wouldn't want to continue to shop in the establishment so vouchers would not be acceptable and totally inappropriate.

Work places and areas which have access to the public have to be safe. Where injury or damage to property occurs or loss occurs you have legal re-dress to put you back in a situation you were prior to the intervening act.

A Sketchleys voucher to have the blood stained clothes should have sorted out the sign on the head incident then.

I am so going to boycott Tesco and buy my killing wares from their more expensive competitors.

Lawyer are we? I would not sue if it were me due to not being a massive fanny. Lost the tip of a finger once back to work inside 2 days. A nasty cut or a bit of concussion is not worthy of thousands of pounds compo though I concede inane was pushing it a bit.

If it's warm and got a bit sweaty it's not nice putting on a cold sweaty helmet, I'd rather keep it on, taking it off only to hop into the shower. Failing that, on my head is probably the safest place to store it away from damage while wandering round a shop carrying a basket and filling it with items that I wish to pay for.

otherwise it gets in the way of getting my wallet out to pay for it, gets picked up by other people if I need both hands to get something out of a freezer cabinet etc.

it depends, if the injury (lets take the sign falling in Tescos as our example here) prevents me from working or getting to work then I'll be out of pocket, the point of compensation is that the person responsible for me not being able to work contributes towards the short-fall in the same way that if you crash into my car, your insurance pays for the damage caused by you to be repaired.

if the injury does not prevent me from working / alter quality of life for myself or my family, then an apology and possibly a good-will gesture (vouchers for the shop or one of those 'use at any' high st vouchers at the discretion of the company in a similar way to arriving home to the wife after stopping at a mates after a lads meet up with flowers or chocolates etc.

the pineapple incident is a bit daft in my opinion, is it upto tesco to prove it wasn't them or the person rummaging above to prove it wasn't them
should the lady have continued rummaging below someone picking pineapples off the shelf above her as she should be aware of her surroundings?

I've worn my helmet in Tescos many times. Guess it varies from store to store. Offensive weapon my ass, he really wanted you to take it off for identity purposes, because he thought you were a thief/just in case you stole something. I'm looking into being a security guard, and heard that's why people can't wear anything on their head because of CCTV.
 
Here's a tip - keep your sweaty helmet on in the shower once in a while, otherwise they start to stink. Another reason not to bother wearing one really ...

Do you know how many head injuries occur from slipping in the shower?
There are several fatalities each year

Surely wearing a helmet in the shower is simple common sense?

The pads come out and get washed every ride or two in summer.

I wear one because I have a habit of falling off logs when I ride along them or when I get a corner wrong and end up head first in a holly bush.

feels unnervingly weird to ride a bike without a helmet.
