New bike damaged when taken out of the box

Yes. But the op ought to make sure that the seller cannot put a plausible claim that the op damaged the bike.

And I didn't say it needed to be demonstrated under the regs.

Have you phoned them? Don't faff around with email forms

I had a new bike with a couple of minor chips, no more left so the shop supplied and fitted mudguards free

I'd personally want it to be perfect but only you can make that call. Given the location of the chip and the apparently pristine condition of the packaging I think it unlikely they could argue it was your fault. The thread title does kinda make it sound like you did the damage though. Just sayin'.

I had a recent warranty claim with PX & to be fair they were quite good. they arranged collection, although courier didn't arrive on the booked day :sad: so that was a pain, it was on a 3 day delivery, so about 1 week had passed before the bike was back with them. I was then quoted a 2 week wait as they were busy in the workshop, but they inspected the bike well within that, about 10 days IIRC & then offered a replacement frame which I then had to wait another 3 weeks for the workshop to re-build & then it was sent back out on a 3 day delivery. So in my experience you could be without the bike for around 6 weeks whilst it gets sorted, so if they offered you a discount it might be worth considering if you want the bike this side of winter :okay:

Yes poorly worded title but didnt know exactly how to word it, no fault of my own as im very careful with things like this and keep all my bikes/cars etc in VGC, opened it up to find the chip.

Had a reply back saying I could either return it for a refund or they'd give me a £20 store credit to use, so asked about getting another one as a replacement if I sent it back but no joy as they said they have very low stock of the bike in the size at the moment so very unlikely this route is possible, so went back to them and asked for a reimbursement in money to get the chip fixed and waiting back on a reply.
What do you all think? Really cant be bothered faffing on returning the thing so fancy a fair reimbursement if poss!

I bought a Dawes hybrid on-line seven years ago. When I took it out of the box, the rear derailleur hanger was sheared off and the mech was flogging about with it. When I tried to fit the front wheel, the slot for the axle skewer was pinched so that it was too narrow to fit. At that stage, I began to wonder what might have happened to the rest of the bike between the front and back wheels. I sent it back for a refund and went elsewhere. One thing I learned is that you need to make sure that the vendor pays all return carriage costs, including all the bubble wrap etc that you will need. You will almost certainly need more packaging materials than the ones that came in the original box, and it doesn't come cheap.

I don't understand your logic on this though: "Given the location of the chip and the apparently pristine condition of the packaging I think it unlikely they could argue it was your fault"... although I don't suspect the retailer would win in consumer rights act respects, I would have thought that if there were a piece of damage on a packaged item and the packaging itself were pristine, that would give the provider more, rather than less, incitement to try for a "it was your fault when you unpacked and assembled it, you stupid and clumsy purchaser" line of argument..?

Are you mad? Get a refund and have done with it.

or accept a faulty item and be plagued by the thought you could have got something better and not faulty, and had the opportunity to do so, but couldn't be arsed.

... and then sell it as used goods later on, having realised you should have just sent it back.

£20 sounds a little low to me, I know how I am wired and a blemish like that would really annoy me, I would be prepared to wait for the bike to be perfect but that's just me.

If you want to keep it, please make sure it's 100% ok with yourself? don't kid yourself and then sell it at a lose.

Also insist upon more money than £20 I think that's insulting to be honest.

Exactly what I was thinking, thats why ive asked for more! Might send it back yes if they dont offer more i.e. the £50 mark, will send them another message saying I will be returning the bike for a full refund unless they reimburse me a larger sum and see what they say

Didnt offer anymore than £30 store credit, so im sending it back for a full refund (just couldnt live with the chip knowing ive paid for a new bike!)
