This thread is going well off topic again, mainly from people simply repeating their firm unfounded views on materials science they have already posted on the first 7 pages.

The Topic was a man being paralysed and suing planet X / planet X's insurers.

The injured doctor’s claim has been settled out of court for £4.5M.

Dr Daniel Gordon was travelling at about 15mph on a grassy slope in Inverness when the bike components failed and he crashed.
He suffered life-changing spinal cord injuries in the August 2020 incident and is now dependent on a wheelchair.
The manufacturers' insurers have settled the case ahead of the start of a five-day high court trial in England.
Following negotiations, it was agreed that Dr Gordon should receive a £4.5m settlement.
It includes a provision for Dr Gordon to return to court and seek further damages in the event he experiences a rare but serious and untreatable deterioration caused by a spinal cyst.
Dr Gordon has returned to work with the NHS in Scotland as a specialist respiratory registrar.

Glad they've paid up, but very frustrating they wait until the eve of the trial to then offer a settlement 4.5 years after the incident

There are many millions of them out there, and I haven't seen any real evidence that they are significantly less safe than metal ones.

Try a search for “bicycle fork recall” on the search engine of your choice.

It takes two to tango.
I suspect if the claimant had been more realistic in the request for compensation, then the matter would have been agreed earlier.
They were seeking £10m and got £4.5m. So we’re over claiming by more than 100%.
I don’t know the case but suspect they have made a number of offers already. And have probably made interim payments too.

Insurance companies are staffed by people with a casual disregard for human suffering, and therefore are more than keen to test the resolve of the claimant up to the point of the court case starting, often to the minute before.

How do I know this? A now deceased friend(ish) of mine was in a car crash in his youth which left him requiring 24hr care. His very resilient and courageous parents ignored the personal aspect, and invited me (amongst others) to both post a reference and then attend the court case to argue for a reasonable settlement. Just before the case started, the insurance company gave a final offer. Whilst the judge may have given a more generous value, they judged that the amount offered was sufficient, and accepted.

I was only holiday at the time, and only got the message requiring my attendance on the day I returned.
