I currently have the families old HUMAX in my bedroom as there is a new one in the living room.

However, the downstairs one is a version 4.39 and mine is still 4.09. I was wondering if there were any geeks out there who could tell me how to update mine?
I have reset it to default and performed a software update but nothing came back (says there are no updates).

This problem needs to be solved as I suddenly cannot tape anything (it cleared what I had taped (it REALLY ANNOYED ME)).

Try a Humax Forum - they will tell you. Software updates over the 'air' aren't available all the time. I've updated my Topfield HD recorder via a laptop !

Do you really need to update it ? Should record no matter what software version - I suggest you've knocked something in the move if it worked downstairs.

It has worked fine in my room for ages. For some reason it just decided to delete what I had recorded and refuse to record anything else.

It is very old now so I suspect it has had its chips.

There may be firmware updates on the humax website, often there will be a 'bootloader' and separate 'firmware' with specific instructions that may allow you to update the box firmware. Some firmware fixes bugs in the software, other firmware adds new or improved functionality.

Could be the hard drive going up the swanny.

The Topfields had an issue with drives going - they got too hot, and without 'active' cooling eventually failed. Ours went this way and started playing up - sent it away and came with a new hard drive fitted. The new drives run much cooler - they replaced the IDE drives with SATA (using an adapter).

Have you tried reformatting the hard drive ?
