So i was out on my specialized allez today newly purchased and got overtaken by a car which slammed on as soon as it got in front of me pretty much. I hit the passenger tail light after having about 4 foot to try and avoid it. I went over the handlebars on to the pavement and hit my hand and elbow.

The motorist is trying to blame me for the crash. Is it my fault or not? I have never had a cycling accident before so don't know what to do. My left knuckle might be broke as well. Doesn't feel good. Should i get my bike looked at by a specialist? I dont know what to do next.

I don't know why he braked. Before i realised he did i was on the floor. And if there were any witness in other cars no one stope to help me. I just hobbled back home with the bike. Luckily i was nearing the end of my ride and only about 4 miles from home.
 
Hopefully you exchanged details with the driver, as all crashes involving personal injury must be reported to Police within 24 hours. If you have none of his particulars, still report it as he may well do the same and the two 'halves' matched up later. You need to get your part of the story recorded, and once you have his details you can set about getting some compensation, if you reckon you're due some.

Sorry to hear that mate. If someone overtakes you then immediately slams on, I'd say it was their fault. Unless there was an unforseen reason for slamming on, like a child running into the road or something.

Whatever happens, I hope you get sorted.
 
Sorry to read this Stephen, I hope it isn't too bad but get it checked out. Playing devil's advocate for a moment, you went into the back of them and unless there's an independent witness, it'll be hard I think to prove anything other than you were at fault. I'm no expert though and I hope things work out for you, good luck.

Well the driver drove off without even getting out of the car for a look. I smashed his tail light as i hit it. I am not bothered about compensation just the damage to my bike really
 
If it were a car then yes that would be the case, I'd be arguing that he hadn't completed his overtaking move.

Sorry to hear that and hope your ok.
If the driver drove off without getting out how is it the hes trying to blame you for the crash.
In any event as HLaB points out above you went into the back of them and it'll be hard to prove anything other than you were at fault.

Best report it. If the driver makes a habit of leaving a crash without exchanging details then the police need to know

That should still be the driver's fault for failing to make sure it was safe to start and complete the overtake.


It sounds like a deliberate action to me, especially as the driver didn't check the damage to the car nor to exchange details.

I reckon it is a Police issue, possibly driving in a dangerous manner and endangering the life of another road user.

Did you get the reg. Report now as a failing to stop or hit and run.

I am currently going through a failure to stop with a Taxi driver... he opened door on me and drove off. Luckily I didnt get any damage on my sturdy bike :smile: Fantastic HD quality CCTV of whole thing. He is getting done for failure to stop and lack of due care and attention iirc.

Oh, get your bike checked out asap. Allez has FACT carbon fork doesn't it - you could have fractured it :sad: and it would be _BAD_ if that failed at 40mph.

Deffo report him for driving like a numpty and failing to stop/exchange details.

Get your hand checked out at casualty too - I broke a finger a year or so ago and waited a couple days to go, got worse and worse. Ended up with pins in (they were not fun).

Get yourself a cheap helmet cam. Look for 808 #11 (google techmoan he does some good reviews of them) - 25 quid for a bit of peace of mind...

Agree'd with all of the above, sounds like hte driver had not completed his overtaking manouvre and has technically failed to stop.
report to the police m8 you're in the clear as far as i can see.
