Think you have got me down as some psycho who beats burglars up for a living lol I had burglars who forced my patio door off the hinges and stole my car keys{ about 6 years ago} I went out in just my jeans no top or shoes on , snuck up behind my car as it was a convertible the back window was hazed so they couldnt see me , opened the drivers door and startled the b,,std who was in the drivers seat ! unlucky for me as he was looking the other way so my punch connected around his ear when I hit him as hard as I could, resulting in me breaking 2 fingers and damaging my knuckles. the other b,,std who was in the passenger side came around and used a stun gun on me which for a minute knocks you senseless I recovered quickly and started fighing with both of them.LUCKILY I had the better of one and the other backed away and ran. Yes in hind site it was a spur of the moment thing and would have been safer to let them take my car, but being me I couldnt let scum do that, no one even came out to help eg alarm on car going , swearing etc . when police eventually came 45 min! they found a knife in the car which I think he was reaching for!! Both were caught and one with stungun 6year sentence, the other 3 years. Stupid I know but we are all human and some people will protect themselves their family and property.That isnt a crime!

And I don't think anyone would argue that you used excessive force. Seems perfectly proportionate to me.

What I'm saying is that, giving some leeway for adrenaline, fear, and heat of the moment, it is wrong to use more force than is necessary to protect yourself and/or your family and/or your property. In your example above, if you had taken a baseball bat to them, and continued beating them well after they were obviously incapacitated, inflicting serious injury, then in my view you would have gone too far.

Its a judgement call as they say!! I would never challenge any burglar again like I stupidly did , they were armed and showed no remourse during the assault or indeed in court as they were smilng at each other and didnt seem perturbed by their sentences knowing full well they would be released in half due to :good behaviour : Stiffer sentencing for using a weapon with intent to do serious injury! say min 10 years would make them think twice. Cowardly act as there were 2 of them and less than half my age, pair of thugs with a string of offences between them.

If, in the heat of the moment, you use a bit more force than is strictly necessary, the court (or more precisely, the jury, if it comes to that) will cut you some leeway.

If, however, you continue to beat someone after they are clearly incapacitated and seriously injure them, then you should, rightly, face the consequences of that. A reasonable person will know when to stop, even with the adrenaline flowing.


This ^^^^ once they are down and out, no need to continue the beating/punishment. That is over stepping the mark.
