Not ture. In two instances where I had to claim form a driver's insurance company, those questions weren't asked.
Erm....not what British Cycling's solicitors told me last week! I have been asked by both them and the driver's insurer if I had any hi-viz and lights on in my collision last month. I had a yellow jacket on, but in my case it doesn't make a difference as it was midday, clear, and the witnesses had spotted me. It is another story if the light conditions are anything but optimal...

If it's not dark enough to need lights, then I've never had a problem seeing cyclists, and only a blind driver or one that doesn't look won't see a cyclist.

that's true. but a proper hiviz, from jewsons or screwfix will attract their attention in the corner of their eye in a way that a red or yellow jumper may not. sadly there are blind and not looking motorists about

Sadly wrong, if a driver is looking they won't see it, no matter what the insurance companies lawyers might try to tell you.
