Sorry for the confusion.

I mistakenly clicked on an old address that was in my delivery addresses book on ebay. This was a house that my Mum lived at years ago.

I immediately contacted the seller, explained my mistake - they said no problem we'll deliver to the address given in my email to them.

The tracking number given doesn't exist on Royal Mails system, I've sat and watched the fella try to track it at the sorting office.

The seller is now claiming that he sent the parcel to the address in the origional order, despite assuring me he would send it to the new address as he agreed.

Ohhhh! You never mentioned the 'contacting seller bit straight away' I get you now. So Ebay would be your best bet and not the seller, they can verify that the tracking number does not exist (or send them a email confirming it does not exist).

You have the patience of a saint. If it was me, i would be taking hostages by now.

Yes, I realised as I clicked the send button, so I emailed them with the correct address which they said was no problem.

They're now claiming that they're not allowed to deliver to an address other than that given in the origional order, which to my mind is nonsense, but if thats true they should have told me in the first place and we could have cancelled the transaction so that I could reorder with the correct delivery address.

Its not really feasible for me to go to the address they say they've delivered to, as its a fair distance away and what are the chances of the occupiers fessing up to keeping a parcel that wasn't adressed to them? Plus its a rough area and I don't fancy going there!

If the seller accepted your explantion and said they would post to your preferd address, then it is there fault. Phone Ebay (emails take to long)

Have you seen the proof of posting with this address on it, when the seller posted it if he used recorded delivery or special delivery he would have a proof of posting with both the tracking number and the post code of where he sent it to.

If he cant produce this get in touch with paypal and request a refund as they will then also askthe seller for proof of delivery, if it was sent recorded or special RM put a copy of the signature online with the corresponding tracking number and that is what paypal ask for usually as proof it was delivered if he cant provide this you should get your money back.

In my experience as a seller paypal usually ask the seller for proof that it was either sent or delivered.

If however it is found that it was delivered and signed for at the address you gave then the mistake is down to you for giving the wrong address.

I have had this kind of thing happen to me when I was a powerseller on ebay where people gave the wrong address by mistake.

The problem I used to get was people saying that they hadnt recieved stuff when I suspected they had then reporting me to ebay/paypal, so I always sent anything of any value by recorded or special then when I had to prove they had recieved it I could point ebay/paypal to the online copy of the proof of delivery and also show fax them the proof of posting.

Royal Mail lost my passport, driving licence, birth and marriage cert in the post (I had to send them all to the local council) somewhere around April last year. It took until November last year to sort it all out and they refunded me for my lost belongings to the tune of £42
You have to keep on and on and on at them. Having said that, the bloomin' council were not that helpful in helping with the chase.

Can I claim through paypal even though I've opened a dispute in ebay? I didn't think of ebay.
Unfortunately for this seller I tend to be a bit like a dog with a bone with this kind of thing.

I dont know but what you can do is log onto your paypal account and if you find the contact us section you can get the phone number for paypal and ring them up and ask them what you can and cant do, I find I get these thing resolved a lot easier on the phone than messing around emailing and getting fobbed off.

.

But as explained - I contacted them literally within seconds and explained my mistake and ask for delivery to a different address - they agreed to this, but are now claiming they're not allowed to deliver to an address other than that in the origional order.
If they'd said that at the start we could have cancelled the transaction and started a new order - but they'd told me they'd deliver to the address I emailed to them and not the one in the origional order.

They certainly haven't told me they have proof, when I first approached them they gave me the tracking number, they then regurgitated the same tracking number when I openened a dispute and again when I escelated the dispute, despite the fact that I'd already ascertained that the tracking number doesn't exist on Royal Mails system.

Ok I see it like this, you gave them the wrong address and yes they are correct the seller does have to use the address the buyer has on their paypal account if the address has been Confirmed otherwise the seller is not covered should any problems arise. But this happens to me on my online shop all the time and as long as the buyer lets me know before i send it I will always change the address, they said they would do that but didnt so someone screwed up at their end, if you can prove that or not depends on if you have that in writing or not.

If they couldnt send it to a different address they should have cancelled the transaction from their paypal account and asked you to repurchase the item from you ebay account this time using the correct address, again a very simple thing to do and I have had to do this also in the past.

But that fact remains that you bought something and unless they can prove that it has been delivered then they owe you money and if you cant put a tracking number into RM's website and come back with the information on the delivery or a signature and they claim that they sent it by either recorded or special delivery then they should refund you and take up any problems they have with RM themselves.

Thats the way I look at it.

That's true. I used to sell stuff on Ebay years ago and Paypal would always inform me that in order to remain protected I always had to send the items to the confirmed addresses, athough I was always flexible. Maybe they just didn't want to take a chance so posted it to the 'confirmed address'? Although I agree that they should have cancelled the order and started again.

Just out of curiosity how many characters are there in the tracking number? There should be 13, starting with two capital letters and ending with GB.

Well, the seller has refunded me this morning after a "mo more Ms Nice Guy" email from me last night.

Very disapointing experience all round, and have left negative feedback for the first time ever, which didn't feel too good.

I'm glad you got a resolution, but it sucks you had to go through such an experience.
