I think most insurers for this circumstance work on the basis that the contractor will be liable, and you should sue them, with their insurance paying out (or the contractor themselves if they don't have suitable insurance).
Not always the case, if you employ a fencing contractor for example and they damage an underground utility cable or pipe then they will probably deny liability unless you made them aware of it in advance. Who knows the location of all the underground utility pipes and cables on their property?
