Frame scratches on brand new bike

I bought a brand new Giant 4.0 CRS on Monday

I rode to the bike store to get some mudguards but couldn't fit them in my bag so the assistant told me to attach them to my frame with some plastic straps. So I rode home when there I noticed that the guards sctratched my frame in a lot of places.

So I go back the the store to get the mudguards fitted because I had problems doing it myself anyway. I also told them one of them employees told me to attach them to my frame and it ruined the finish is there anything they can do to repair the scatches they said no. There is nothing they can do to repair the scratches. They didn't even apologise.

Where do I stand with this, can I get the scratches repaired and can I hold the store liable for it or do I have to live with them even though my bike is brand new?

I'm no legal expert but i would imagine that as you've strapped them to the frame or given the shop assistant your permission to do so then there is very little that the shop have to do to repair the damage in a legal sense ?

And anything they did do would be out of a goodwill gesture in the hope that you continue to buy their goods or use their services

not really useful but there is legal recourse when you're told to do something that causes you loss by someone you reasonably expect to have expertise that later turns out to be bad advise

He wasn't 'told' to do it - just advised. TBH it's pretty obvious if you attach anything to a bike in a 'temporary' manner it will scratch it - just road vibration alone will cause this.

Best option - car polish and some car touch up paint.
