,i was behind him and tried to swerve around but i hit the kerb as i was heading or someones drive entrance and hit the deck hard.

You seem to be saying in the OP that there was insufficient distance between you and the bicycle in front of you. As a result of this you were unable to stop or take evasive action without losing control and crashing.

I think I'd be inclined to sue the rider in front of you for not leaving enough space behind him.

I hate it when people do that.

One way or another, it all seems to be someone else's fault and I think they should jolly well pay for your repairs.

Aren't other people simply awful?

I only wish it had been my fault.... I'd pay up in a jiffy. Grrrr... Other people!

According to the solicitor the pothole was caused by the electric company who filled in the road they made for repair and did not maintain it, it is their job along with the highways agency to inspect and maintain .

That's not really related to my point though - you complained about being overcharged by the council. We can all agree we're being overcharged by the electric company!

If the pothole was reported and the council did not repair it in a reasonable period of time then fair enough, contact a solicitor to find out your options. If it wasn't and you just happened across it through sheer bad luck, then chalk it up to experience.

NO i said the council had made more money than it had spent , an observation not a complaint to counter the fact you were bemaoning the poor council having to pay compensation.

If you and Bicycle do not agree with my actions then fair enough , you have both made your points .

Now stop trying to change my opinion all because it does not agree with yours.

And thanks for the concern about whether my injuries were ok , it seems you both jumped on the thread as soon as i mentioned i might be able to get some recompense.I might be right and i might be wrong but common decency and manners should prevail .

I'm not trying to change your opinion. Little chance of that.

I was never going to change the opinion of someone whose (almost) first response to crashing while trying to avoid someone they were riding too close to was to take photographs in support of a compensation claim.

If I am trying to do anything, it is to highlight the mindset of someone who allows no safety margin between self and cyclist in front, is injured as a result and then starts to plan how to prove someone else was at fault.

Sometimes we just get things wrong and the result is painful. Life can be like that.

If you're not concentrating or are not fast enough on the brakes, don't get so close.

Had you left as little margin as you did in any other form of transport (car, motorcycle, lorry, tractor) almost the whole forum would be aghast at your behaviour.

Do so on a bicycle, suffer as a result and suddenly you're a compensation claimant.

It's not just RLJ miscreants who lead to cyclists being howled at in derision in some parts of society.

I don't do the comedy, I just see it and laugh. :biggrin:

Look, it's damned bad luck and very annoying. You mentioned already that the worst you came away with was a very bruised hip so I'm working on the assumption that your injuries are ok.

Nor am I attempting to change your opinion but read your original post and it does read as 'I've had an accident and someone is going to pay for it!'

Anyway, I've made my point, you've made yours. Let's agree to disagree and not create one of those dull and circular arguments so typical of internet forums.

Just an update ...

I know some did not like the idea that i might make a claim against the council / highways agency , i was advised to contact the solicitor by the cycle club `s leader of the group the incident happened in .
After speaking to the solicitor i have been told that unless the claim is over £1000 then it is not worth pursuing as they cannot recoup their fees for such a small amount.
The only other recourse would be to use the small claims court to try and get some sort of payment, after some consideration i have decided that as i have managed to straighten the shifter that was bent in question and the other cyclist`s bike has been fixed, luckily saving the wheel and his injuries have not been to severe that it is not worth chasing after a few pounds.
The pothole has been reported to the CTC although i did inquire with them if the hole had already been reported and i have not received any response.


The cuts and bruises are healing nicely and i will see the other cyclist tomorrow .

Well I think you are right to re-think. You need to go for something serious in future where you will get 10s of thousands..

When I got knocked off with cuts and bruises I did pursue the culprit and successfully won the cost of some new trousers from BHS. No lawyers were enriched in the process. The driver also wrote to thank me for taking a reasonable view of the matter.

I suppose he realised the hardship of being "sans cullottes" :biggrin:
