What happens next if someone refuses to pay after hitting you and it was their fault? I had an accident on my bike and this indian woman hits me from the side at 40MPH on a dual carriageway..

I had two helpful witnesses both saying "of course she will have to pay for the cover of the bike" well duh. She just stood there saying how sorry she was and the next day called up saying "Is there anything I can do to make it up to you?"

She AGREED paying the cover of the bike the next day, including the cost of my cloths etc but after two weeks of consideration, she had the cheek to say she won't pay a penny... so she rejected to pay for the cover of the damage she has done. Perhaps she was thinking of reparing her side mirror first..

Now, you haven't cycled for over two weeks costing two weeks of training. You know your going to get a new bike very soon as she said she will send a cheque, then to say no.Now I get the police/solicitor involved? How long is this going to take! :wacko::ohmy: Anyone feel my frustration?

I know I will EVENTUALLY get what I deserve as I got two witnesses. They even said to contact them if anything goes wrong. End of the day I got nothing till that day comes.. and it could even take several months. :wub:

Listen everyone.

If you are in an accident and its the other party's fault, nomatter how you feel, act like you're really hurt and phone an ambulance on 999.

When the E-operator hears its a RTA, the police are called out.

Take photos of the other party and their vehicle - especially their Reg No; your bike and the scene of the incident.

Get witnesses.

Also, make sure you're in the CTC or a trade's Union for legal aid.

When the 'Blood bus' arrives, shout about the pain in your arm and wrist.
When the Cops arrive, point out the B who hit you and angrily explain what happened.

When the Parameds want to take you away, instruct the police to take your bike home and photo them with your bike.

Leave NOTHING to chance. Nail the 'B'.

I don't understand. There was a road accident. Why weren't the police involved? Why wasn't it reported to the insurance? You don't negotiate w/ the driver. The lawyers negotiate.

Well as she cooperated we thought it was not necessary. She obviously wants to take it one step further and that's exackly what is going to be done.

Yep

Not sure you should always call an ambulkance by faking an injury though.

So some poor sod 10 miles away, who is seriously injured, dies because there isn't an ambulance available? Great.

depends how much damage - if there was not £1k legal teams will not generally take on (bike and medical), and to go to court for less than that wont be worth it. a horrible situation as its not your fault but one of those things

I understand where you're coming from...calling 999 is a good idea so there is a record of it. Actually getting an ambulance out when you do not need one isn't. It costs over £600 per call out for an Ambulance (before any treatment) and someone else might need it more than you.

No-one called the cops when I was struck down, just the ambulance service and they didn't get the cops either.

When the police were told, they weren't at all happy about investigating a matter that they heard about 3 days after it happened. Especially as the driver scarpered.

They gave up looking for the driver (who had given his name as Ahmed someone or other with a false address) and decided to stop looking as they were too busy with people getting killed on the ring-road. In the end the witnesses and the CTC were my saving grace not the cops.

I was in an incident many years ago when some daft sod knocked me up the kerb and I hit a wall.
A passer-by kindly ran to a phone kiosk ( remember them before mobiles ) and dialled 999.
I was up and shouting at the driver so the kind passer-by told the E-operator I was fine. The operator said if there was no personal injury, there's no need for the police to attend.

While the passer by was walking back, the motorist buggered off. I got half his number and the colour of the car but the Police still weren't interested when I went to Solihull Nick.

I needed a new front rim and left brake lever.

That is NOT going to happen again

So, how would a Police car or Ambulance in transit have stopped the driver from driving off?
