Not as Advertised!

Hi all,

Well I feel I'm getting close to collecting my new road bike through the C2W scheme. I have chosen a Wilier Escape 09, which is advertised on the bike dock web page with carbon seat post, stem and handlebars as well as Campag Veloce group set.

Although I had visited the shop a number of times they never had one in stock so relied on this description. It was only on Thursday when I went in I saw one and it had a very different set up. Alloy seat post, stem and handlebars, Veloce brakes and all drive train parts were cheaper Campag parts.

I rang the shop and spoke to a sales guy who had confirmed in the past that the bike would be supplied with the Veloce group set. I am not unreasonable and have sent an e-mail explaining the differences and also said I feel that carbon stem and handles bars are normally seen on higher priced bikes and would accept these being omitted however feel that a carbon seat post and Veloce group set should be acceptable in this price range.

Where do I stand with regards my rights? How far should I push, as although I am using the C2W the shop still gets all its money?

I would have said, if an item is advertised with a defined spec, and there is not note on the ad anywhere saying somehting like 'exact specification may vary from model to model' or 'if this model is not available one of equivalent specification will be supplied', and the shop did not mention at any point in the sale that the spec might have changed, you have every right to terminate the transaction.
 
For starters Save a copy of the advertised bike as it currently is on the site.

They are not legally bound to supply everything as is stated (there's probably some Errors and Omissions clause on the site somewhere) but the Veloce componentry is such an essential part of the product description that they should fulfill this part of the obligation so refuse to accept the bike unless this is satisfied.

What Camag alternative were they offering?

I am more interested in getting the bike as the Bike Dock has a reputation of uping the price of their bikes, this is why I choose this one as the spec seemed good value. As I can't see any of the covering terms you have highlighted I'm hoping to get them to increase the spec on my bike.

Hi accountantpete,

I have saved a copy and to be honest am surprised they have not changed the advert as I highlighted it to them on Friday morning.

They had used Mirage on the chainset and I believe the derailleurs, as for chain, cassette, shifters I am unsure.

Stick to your guns and get better components (as advertised) or compromise by getting them to knock off money (that your happy with) for the inferior parts.
 
There's only a gnats whisker between the Veloce and Mirage groupsets - personally if it was a complete Mirage system i'd take it and use the "downgrade" to negotiate an upgrade in other areas such as the tyres.

I'd insist on the carbon seatpost as advertised though.

Maybe they buggered up their advert...

THe problem is that it is a totally different bike to the one advertised by them (apparently incorrectly), and the one you thought you were ordering, and you would probably not have ordered it if advertised with the correct spec. You must have a very strong case for refusing the bike, but equally I can't see them up-specc'ing the Escape. IF you were willing to take the bike maybe a very hefty discount should be offered to you in view of their apparent incompetence - or suggest a higher spec bike for the same price. But basically it is NOT the bike advertised, and you should not accept it if you are not happy with it

- out of interest - just been to the BikeDock website - Escape 09 still advertised as full Veloce, Carbon finishing kit, and an SLK saddle! Someone has got it seriously wrong. I would think you you have a very strong case for some action on their part to remedy the situation.

Cheers for the advice guys, Bike Dock did use to do the Wilier Escape mirage 09 but said the Escape 09 had superseded the Mirage. All the more reason why it looked like such good value.

I'll see what happens this week and keep you up to date.

Had a long winded e-mail last night saying that it was human error but they would not be prepared to compromise on specification so have decided to cancel the order and just stick with the current hybrid until next spring.

Going to get some clipless pedals and shoes in the mean time.

Went to Chain Reaction to buy a set of SPD-SL pedals and shoes. Very pleased with my choice and the price. Had a short ride around the house and all working fine, just start the sweep stake on how long to my first 'Moment'!
