Injured by a VOI scooter - legal position?

Today I was involved in a collision with the rider of a VOI rental scooter. The upshot is that I have sustained a very serious shoulder injury which doctors have told me will need surgery followed by months of rehab. I can't work, cycle, drive, dress myself... Not ideal for a self employed person not eligible for sick pay.

Does anyone know what my legal position is re. VOI and /or the rider? He is easily traceable by VOI but I don't have his details.

If you have the time and location, VOI should be able to narrow down their scooters in the area.

Treat it as any otht collision, only going through the e-scooter hire company directly.

They should have insurance.
Are you a member of British Cycling or similar and can get legal advice. Or legal through your home insurance? Let them handle it. Or find a no win no fee cycling specialist solicitor if not

Sorry to hear of your problem. Sage advice from others above but, based on the experience/history of Voi here in Bristol, don't expect them to rush to help identifying the rider. You may have to go down the solicitor route just to get them to respond to you.

The voi scooter is a motor vehicle and the rider has the same legal responsibilities as a car driver would in such circumstances. If you know the serial number Voi can trace him, but they may be reluctant to do so if you don't- trolling through the records one by one to compares GPS and date/time data is a chore that I'm not sure they can be bothered with, and they were recently prosecuted locally for failing to identity a rider to the police.

If the rider cannot be traced, ie, is unidentified, you can lodge a claim with the motor insurers bureau.

All VOI 'scooters' have registration numbers. Did you, by chance, take it down?
Could you go via your own house/contents insurance? Maybe even car insurance could offer advice (but they might bump your insurance up next year for the audacity of asking them!!)

Did you report the matter to the police. AFAIK they can get details of the rider.

They can although Voi have a recent track record of criminal non cooperation in such matters.

And the dibble won't give them to the OP. They'll give the details to his insurer or solicitor provided they can justify the request (which I'm sure they can) and provided Voi cooperate and do actually identify the rider to the dibble (which they were recently prosecuted for failing to do locally.)

VOI are the insurance company for their e-scooter hire schemes, as well as being the owners of the e-scooters.

As the owner there is the legal obligation, on their part, to name the rider/driver at the time of the incident.

How did the accident actually happen? Was the scooter rider injured too?
I’d definitely report to police while everything is fresh in your mind with any info about the third party and circumstances
